Liability Waiver

Please read carefully. This waiver affects your legal rights. By accepting it, you give up the right to make certain claims against Hatch And Learn.
This waiver is between Hatch And Learn, 9A Erb St East, Waterloo, ON N2J 1L4 (“Hatch And Learn”), and the person or organization booking the kit (“Client”). It applies to the Hatch And Learn chick hatching program provided under the Rental Agreement.
1. Risks
1.1 The Client understands that hatching eggs and caring for live chicks involves risks, including:
- illness from germs, such as salmonella, carried by chicks, eggs or bedding
- scratches, pecks or other minor injuries
- allergic reactions to chicks, feathers, dust, feed or bedding
- burns, fire or electrical hazards from the heat lamp and incubator
- tripping over, knocking over or damaging equipment
- damage to property, such as floors, furniture or carpets
1.2 Some people are more at risk of serious illness from these germs, including children under 5, pregnant people, adults over 65 and anyone with a weakened immune system. The Client is responsible for deciding whether these people take part and how closely they are supervised.
1.3 The Client accepts these risks and any others connected with the program.
2. Supervision and Safety
2.1 The Client is responsible for supervising everyone who handles the eggs, chicks or equipment, including children, students and visitors.
2.2 The Client will make sure everyone washes their hands before and after handling the chicks, eggs or equipment, and does not eat, drink, kiss the chicks or touch their face while handling them.
2.3 The Client will keep the heat lamp secured as instructed and away from anything flammable, and will follow all other safety instructions from Hatch And Learn.
2.4 The Client is responsible for knowing about any allergies or health conditions of the people taking part, and for deciding whether they should handle the chicks.
2.5 If the Client is a school, daycare or other organization, the Client will let parents or guardians know about the program before it starts, so they can share any allergies or health concerns.
2.6 If anyone becomes ill after contact with the chicks, eggs or equipment, the Client will make sure they get medical care, tell the doctor they’ve been around chicks, and let Hatch And Learn know.
3. Release of Liability
3.1 To the fullest extent allowed by law, the Client releases Hatch And Learn and its owners, employees, contractors and representatives, including anyone delivering or picking up kits for Hatch And Learn, from all claims, costs and legal fees for any injury, illness, loss or damage to people or property connected with the program, including claims caused by the negligence of Hatch And Learn.
3.2 This release is made by the Client on its own behalf and on behalf of its employees, representatives, students and anyone else taking part in the program.
3.3 This waiver covers the program wherever it takes place, including when the Client or a staff member takes the kit or chicks to another location, such as home over a weekend.
4. Limit on Liability
4.1 To the extent allowed by law, if, despite this waiver, Hatch And Learn is found responsible for any injury, illness, loss or damage, the most Hatch And Learn will owe is the amount the Client paid for the program.
4.2 Hatch And Learn is not responsible for indirect losses, such as lost wages, missed work, travel costs or time spent.
5. Indemnity
5.1 The Client agrees to cover Hatch And Learn for any claims, costs and legal fees brought by anyone else, including students, children, parents, staff or visitors, for injury, illness, loss or damage connected with the Client’s use of the kit or care of the chicks.
6. Authority
6.1 If the Client is booking for a school, daycare or other organization, the person accepting this waiver confirms they are authorized to accept it on the organization’s behalf.
7. Acknowledgement
7.1 The Client confirms they have read and understood this waiver, have had the chance to ask questions or get legal advice, and are accepting it voluntarily.
8. Duration
8.1 This waiver continues to apply after the session ends.
9. Entire Agreement
9.1 This waiver, together with the Rental Agreement, is the entire agreement between Hatch And Learn and the Client about the program.
10. Severability
10.1 If any part of this waiver is found to be invalid or unenforceable, the rest remains in effect.
11. Governing Law
11.1 This waiver is governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
