By accepting this agreement, you also accept our Liability Waiver. Please read it before booking.
This agreement is between Hatch And Learn, 9A Erb St East, Waterloo, ON N2J 1L4 (“Hatch And Learn”), and the person or organization booking the kit (“Client”).
1. The Kit
1.1 The kit includes 7 fertile chicken eggs, an automatic incubator, a candling light, a brooder box, a heat lamp, wood shavings, chick feed, a food dish, a water silo, a paperback instruction manual and lesson plans.
1.2 Support includes weekly video instructions and a personal cell number the Client can text at any time. The number is provided on drop-off day.
1.3 All equipment remains the property of Hatch And Learn.
2. Session
2.1 Sessions run on a fixed schedule of about 30 days. The drop-off, expected hatch and pickup dates are shown on the booking calendar and in the booking confirmation.
3. Fees, Deposit and Refunds
3.1 The program cost is $300 per kit, which includes delivery, setup and pickup. HST is not charged, because Hatch And Learn is a small supplier under CRA rules.
3.2 A $125 security deposit is also required.
3.3 Full payment of the program cost and deposit is required to reserve a session. A session is not reserved until payment is received.
3.4 Schools, school boards, parent councils and daycare centres that pay by invoice may reserve a session once Hatch And Learn has issued the invoice. Payment must be received before drop-off day. If payment hasn’t been received, Hatch And Learn will not drop off the kit, unless another arrangement has been agreed in advance.
3.5 The deposit is refunded in full once the kit is returned complete and undamaged, along with the chicks, unless another arrangement has been made with Hatch And Learn. Hatch And Learn starts the deposit refund on pickup day. If any part of the kit is missing or damaged, Hatch And Learn may use the deposit to repair or replace it.
3.6 All refunds under this agreement are issued electronically, or by cheque if the Client paid by cheque.
4. Delivery and Pickup
4.1 Hatch And Learn delivers only within its delivery area, as listed in the FAQ. If the Client’s address is outside that area, Hatch And Learn may cancel the booking and issue a full refund of the program cost and deposit.
4.2 Hatch And Learn delivers the kit to the Client’s location on the first day of the session and sets it up. Delivery is between 8am and 4pm, and an estimated arrival time is sent once the route is planned.
4.3 At the end of the session, Hatch And Learn returns to the Client’s location to collect the kit and the chicks. The pickup date and time will be coordinated with the Client in advance.
4.4 If no one can be present at drop-off or pickup, the Client will let Hatch And Learn know in advance.
4.5 If no one is present at pickup and the kit can’t be collected, the Client must arrange another pickup time with Hatch And Learn or return the kit and chicks to Hatch And Learn. The deposit is not refunded until the kit has been returned.
4.6 If no one is present on drop-off day, Hatch And Learn will make a good faith effort to contact the Client. If Hatch And Learn can’t reach anyone and no other arrangement is made, the booking is cancelled. Hatch And Learn will refund the program cost in full and keep the $125 deposit.
5. Client Responsibilities
5.1 Follow the instructions provided, including daily care of the eggs and chicks.
5.2 Place the kit near an outlet, away from drafts and heaters, and keep pets away from it.
5.3 For schools and daycares, arrange for a staff member to take the chicks home over any weekend after the hatch.
5.4 Contact Hatch And Learn right away if a chick seems sick or is having trouble hatching.
5.5 Use the kit only as instructed. Don’t move, open, take apart or modify the incubator or other equipment except as the instructions describe, and don’t use the kit for any other purpose.
6. Cancellation
6.1 Cancellation requests must be sent by email to info@hatchandlearn.com.
6.2 Cancellations made 7 or more days before drop-off: full refund of the program cost and deposit. Cancellations made less than 7 days before drop-off: full refund of the program cost, but Hatch And Learn keeps the $125 deposit.
6.3 If the Client cancels after drop-off, Hatch And Learn will refund the program cost in full and keep the $125 deposit. Hatch And Learn will arrange a time with the Client to collect the kit and the chicks, and the kit must be returned complete and undamaged.
6.4 Requests to reschedule must be sent by email at least 14 days before the session starts. Rescheduling depends on availability and isn’t guaranteed.
6.5 Hatch And Learn may withdraw from this agreement and cancel a booking at any time, for any reason. If Hatch And Learn withdraws, before or during the session, the Client receives a full refund of the program cost and deposit.
7. Hatch Guarantee
7.1 By day 9 of incubation, it’s usually clear whether the eggs are developing. The Client must check the eggs and let Hatch And Learn know by day 9 if none of them show signs of development.
7.2 If none of the eggs are developing, Hatch And Learn will come to the Client’s location and replace them with eggs it has been incubating itself, so the replacements hatch on the original schedule.
7.3 If none of the replacement eggs hatch, Hatch And Learn will refund the program cost in full. Once it’s confirmed that none have hatched, Hatch And Learn will arrange to drop off chicks for the Client to enjoy for the rest of the session. The session is not extended.
7.4 Hatch And Learn does not guarantee how many eggs will hatch. It’s normal for some eggs not to hatch. A refund is issued only if none of the eggs hatch. If even one egg hatches, no refund or replacement is given.
8. Authority
If the Client is booking for a school, daycare or other organization, the person accepting this agreement confirms they are authorized to accept it on the organization’s behalf. The person booking also confirms they have permission to keep the kit and chicks at the delivery location.
9. Events Beyond Hatch And Learn’s Control
Hatch And Learn is not responsible for delays or changes caused by events beyond its reasonable control, such as severe weather, illness, vehicle problems or egg supply issues. If this happens, Hatch And Learn will let the Client know as soon as possible and arrange a new delivery or pickup time.
10. Notices
